LEGAL NOTICE – TOPOGRAPHICAL SURVEYS

1. Introduction
This Legal Notice governs the provision, use, and reliance upon all topographical surveys, measured surveys, site data, drawings, models, and associated outputs (“Survey Information”) produced by Draconis Archivision or our partners Cefn Gwlad Designs Ltd (“the Company”, “we”, “us”, “our”).

By commissioning, receiving, accessing, or relying upon our Survey Information, you (“the Client”, “you”, “your”, or any third party) agree to the terms of this Legal Notice.

 

2. Scope of Services
2.1 Topographical surveys are carried out in accordance with the agreed written brief, quotation, and specification.
2.2 Survey outputs may include (but are not limited to):

Levels and contours

Spot heights

Building footprints

Boundary features

Hardstanding and landscaping

Visible drainage features

Surface utilities

Trees and vegetation (where requested)

2.3 Any items not expressly included within the agreed scope are excluded.

 

3. Survey Limitations
3.1 Surveys record features visible and accessible at the time of inspection only.
3.2 We cannot capture or verify:

Obstructed areas

Concealed structures

Underground services

Covered drainage runs

Features hidden by vegetation, vehicles, or materials

3.3 Where access is restricted, assumptions or omissions may apply.

 

4. Underground & Utility Services
4.1 Unless specifically agreed in writing, surveys do not include underground service detection.
4.2 We do not locate or guarantee the position of:

Water mains

Gas lines

Electric cables

Fibre/data routes

Drainage below ground

4.3 Specialist utility surveys must be commissioned separately.
4.4 We accept no liability for losses arising from reliance on assumed or unverified service locations.

 

5. Accuracy & Tolerances
5.1 Surveys are undertaken using industry-standard equipment and methods (e.g., GNSS, Total Station, Laser Scanning where applicable).
5.2 Data is provided within standard professional tolerances appropriate to:

Survey scale

Site conditions

Equipment used

Control available

5.3 If higher accuracy is required, this must be specified in writing prior to survey.
5.4 We accept no liability where data is used beyond its intended tolerance or purpose.

 

6. Client Responsibilities
The Client agrees to:

Provide safe and lawful site access.

Disclose known hazards.

Provide boundary or title information where relevant.

Inform us of required survey extents and deliverables.

Failure to provide accurate instructions may result in omissions for which we accept no liability.

 

7. Boundaries & Legal Title
7.1 Topographical surveys do not constitute legal boundary determinations.
7.2 Boundary lines shown are indicative only and based on:

Physical features

Client instruction

Available mapping data

7.3 Legal boundary disputes must be referred to a chartered land surveyor or legal professional.
7.4 We accept no liability for boundary disputes or land ownership matters.

 

8. Levels & Datum
8.1 Levels are provided relative to the agreed datum stated on the drawings.
8.2 If no datum is specified, an assumed datum may be used.
8.3 The Client must verify datum compatibility before design or construction use.

 

9. Vegetation & Natural Features
Tree positions, canopy spreads, and vegetation extents are approximate where dense growth restricts measurement. Root protection areas are not included unless separately commissioned.

 

10. Digital Models & CAD Data
10.1 Survey data may be issued in CAD, BIM, or point cloud formats.
10.2 We do not guarantee compatibility with all software.
10.3 2D drawings take precedence over editable CAD files in case of discrepancy.
10.4 Third-party manipulation of digital data voids liability.

 

11. Use & Reliance
11.1 Survey Information is prepared solely for the commissioning Client and specified project.
11.2 No third party may rely upon it without written collateral warranty.
11.3 Verification checks must be undertaken prior to:

Construction works

Groundworks

Foundations

Infrastructure installation

 

12. Changes After Survey Date
12.1 Surveys represent site conditions at the date of capture only.
12.2 We accept no liability for changes occurring after survey, including:

New structures

Demolition

Ground movement

Landscaping alterations

Updated surveys must be commissioned where time has elapsed.

 

13. Health & Safety
13.1 The Client must ensure the site complies with Health & Safety legislation.
13.2 We reserve the right to suspend works if conditions are unsafe.
13.3 Additional charges may apply for aborted or delayed visits.

 

14. Environmental & Ground Conditions
We do not assess contamination, ground stability, flood risk, or environmental hazards unless separately contracted.

 

15. Professional Indemnity & Liability Cap
15.1 We maintain Professional Indemnity Insurance where applicable.
15.2 Our total liability is limited to the fee paid for the survey services.
15.3 We shall not be liable for:

Construction costs

Project delays

Loss of profit

Development losses

Indirect or consequential damages

 

16. Intellectual Property
All survey drawings, models, and data remain our intellectual property until full payment is received. A project-specific usage licence is granted thereafter.

 

17. Third-Party Data Integration
Where OS mapping, aerial imagery, or third-party datasets are incorporated, their accuracy is not warranted by us.

 

18. Governing Law
This Legal Notice is governed by the laws of England and Wales. Disputes fall under the exclusive jurisdiction of those courts.
